Manufactured Homes List
The Commercial and Consumer Tribunal (the Tribunal) has jurisdiction to deal with applications under the Manufactured Homes (Residential Parks) Act 2003 (the MH Act).
The objects of the MH Act are to regulate and promote fair trading practices in the operation of residential parks as set out in section 4 of the MH Act.
The Tribunal has jurisdiction to deal with disputes between park owners and home owners if internal dispute resolution processes fail to resolve disputes.
The Tribunal encourages parties to use their internal dispute resolution processes and, if necessary, mediation, eg. as provided by the Department of Justice as set out at page 43 of the Manufactured Homes - Park Owner "Good Business Guide" or page 3 of the "Buying or living in a manufactured home" Fact Sheet prior to filing an application in the Tribunal.
If your case relates to a market rent review, then the table Comparison of Village Facilities and Site Rents may assist you in preparing your evidence. You are not obliged to use this table and you may, of course, expand on it to prove your case.
