Q1 What is the Tribunal and can it assist me?
The Tribunal has a court substitute jurisdiction with regard to resolving disciplinary proceedings against licensees and registered employees, review administrative decisions of the Chief Executive and decide claims over $10,000 against the Claim Fund.
Q2 How do I commence an application to claim against the fund?
- Contact the Office of Fair Trading by telephone on 13 13 04.
- Complete three copies of the application form and either deliver or mail the forms to the Office of Fair Trading at Level 21, State Law Building.
There is no application fee for filing an application for a claim against the fund.
Q3 How do I review a decision of the Chief Executive?
- Obtain a copy of the Form 1R: Application - Review by contacting the Commercial and Consumer Tribunal Registry (CCTR) on 3247 3333 or by accessing this page.
- Complete 3 copies of the application form as set out in the instruction sheet.
- File the three (3) signed application forms in the registry together with the filing fee payable by cheque, cash, money order or credit card (Visa or MasterCard only). Q6 What is the Commercial and Consumer Tribunal Registry?
The Commercial and Consumer Tribunal registry provides administrative support for the Tribunal. Registry staff can provide you with procedural information but are not permitted to give legal advice. Q7 What are directions hearings?
Directions hearings are usually the first step in the Tribunal proceedings. At a directions hearing the tribunal usually issues directions for the parties to prepare their case for hearing. Statements and documents from parties and witnesses will be required to be filed in the registry in triplicate and one copy delivered to the other party/s by the date/s directed. Witnesses who provide statements are required to be available for cross-examination under oath at the hearing unless otherwise agreed with the other party.

Q9 Can I have a copy of an audio CD?A request must be made in writing to obtain a CD, including the application number and date of the hearing. A fee of $25.00 applies when requesting a CD and must be paid with the written request; cheques are to be made payable to the Commercial and Consumer Tribunal or can be made by EFTPOS payment (44kb, PDF).
Q10 Can I have a copy of a transcript?
A request must be made by completing a Transcript Order form (36kb, PDF). The Tribunal registry will contact Auscript to arrange transcription of the recording of the relevant Tribunal proceedings. Auscript will then deal directly with the party and payment for the transcription will be made to Auscript.
